End User Terms

01The agreement

These End User Terms (the Terms) are a binding agreement between We The Folks (we, us), the provider of GitHub Actions for Jira(the App), and the organization that installs the App into its Atlassian Jira site (you, the Customer).

You accept these Terms by installing, purchasing, or using the App. If you install the App on behalf of an organization, you confirm that you are authorized to bind that organization. If you do not accept these Terms, do not install or use the App.

02Atlassian Marketplace and precedence

The App is distributed through the Atlassian Marketplace and runs on Atlassian Forge. Your use of Jira and of the Marketplace itself is governed by your agreement with Atlassian, not by these Terms, and we are not a party to it.

Where these Terms conflict with a separate written agreement signed by both you and us, that signed agreement prevails. Where they conflict with our Data Processing Addendum on the processing of personal data, the Addendum prevails.

03Licence to use the app

Subject to these Terms and to payment of any applicable fees, we grant you a non-exclusive, non-transferable, non-sublicensable right to use the App for your internal business purposes, for the term of your Marketplace subscription and on the Atlassian sites covered by it.

The App is licensed, not sold. All rights not expressly granted are reserved.

04Installation and administration

The App is configured per Jira project by a Jira project administrator. Configuration requires connecting the project to a GitHub App installation, which in turn requires that a person with the necessary rights installs our GitHub App on the GitHub organization or account concerned, on the repositories you choose.

You are responsible for who you grant Jira project administrator rights to, and for which repositories you expose to the App. Within a connected project, the ability to launch a deployment follows the Jira EDIT_ISSUES permission on that project. Configuring the App therefore grants deployment rights to a group of people that you define in Jira, and it is your responsibility to keep that group correct.

05Your responsibilities

You are responsible for:

• The content and effect of the GitHub Actions workflows the App dispatches. The App starts workflows you have written and points them at repositories, branches, and environments you have chosen. It does not review, validate, or vouch for what those workflows do.
• The configuration you enter: repositories, workflow files, refs, input definitions, default templates, execution order, and failure policies.
• Compliance with the GitHub Terms of Service and with your own internal change, release, and access-control policies.
• Ensuring that your use of the App complies with the laws applicable to you, including data protection law.

06Workflow inputs are operational data

We are not liable for the exposure of any credential that you or your users place into a workflow input or an input default template.

07Acceptable use

You must not:

• Use the App to dispatch workflows on repositories you are not authorized to operate.
• Reverse engineer, decompile, or attempt to derive the source of the App, except to the extent that this restriction is prohibited by applicable law.
• Resell, sublicense, or make the App available to third parties as a service outside your own organization.
• Use the App to circumvent GitHub rate limits, to interfere with the GitHub or Atlassian platforms, or in a way that imposes an unreasonable load on either.
• Use the App for anything unlawful.

08GitHub and other third parties

The App integrates with GitHub. It communicates with github.com and api.github.com and with no other external host. GitHub is an independent third party: its availability, rate limits, pricing, and terms are outside our control, and a change on GitHub's side may affect the App.

You need a GitHub account and, for the connected repositories, an installation of our GitHub App. Your relationship with GitHub is governed by your agreement with GitHub.

09Fees, billing and refunds

Where the App is offered for a fee, pricing is the pricing shown on the Atlassian Marketplace listing. Billing, invoicing, taxes, renewals, and refunds are handled by Atlassian under the Atlassian Marketplace terms and Atlassian's refund policy. We do not collect payment details and we do not process payments.

Where the App is made available free of charge, no fee is due and the provisions of this clause do not apply.

10Support

Support is provided by email at dominik.szymanski@wethefolks.eu. We aim to acknowledge requests within two business days. Support covers the App itself: it does not cover your GitHub Actions workflows, your Jira configuration, or the GitHub and Atlassian platforms.

To investigate an issue we may ask you for information such as a Jira project key, a deployment identifier, a workflow run URL, or a description of the configuration. Sending us that information is your decision, and you should not send us credentials.

11Availability and changes to the app

The App runs on Atlassian Forge and depends on the availability of Atlassian's and GitHub's platforms. We do not offer an uptime commitment, and we do not guarantee that a deployment dispatched through the App will start, complete, or be tracked to completion.

We may add, change, or remove features. We will not deliberately remove a material feature without notice through the Marketplace listing or the App itself, but we may make changes required for security, for compatibility with Atlassian or GitHub, or to comply with the law, at any time.

12Intellectual property and feedback

We own the App, its source, its interface, and all related intellectual property. You own your data, your Jira content, your repositories, and your workflows. Nothing in these Terms transfers ownership either way.

If you send us feedback or a feature suggestion, you allow us to use it without restriction and without obligation to you. We will not identify you as its source without your permission.

13Data protection

Our handling of personal data is described in the Privacy Policy. Where we process personal data on your behalf as a processor under the GDPR, the Data Processing Addendum applies and forms part of these Terms.

14Confidentiality

Each party will keep the other's non-public information confidential and use it only to perform under these Terms. This does not apply to information that is public through no fault of the receiving party, was already known to it, is independently developed by it, or must be disclosed by law.

15Disclaimer of warranties

To the maximum extent permitted by law, the App is provided as is and as available, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will meet your requirements.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud, or for fraudulent misrepresentation.

16Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, goodwill, or data, however caused.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these Terms and the App is limited to the greater of the fees you actually paid for the App in the twelve months before the event giving rise to the claim, or one hundred euro (EUR 100).

17Term, suspension and termination

These Terms apply from the moment you install the App and continue until the App is uninstalled or your Marketplace subscription ends. You may stop using the App at any time by uninstalling it from your Atlassian site.

We may suspend or terminate your use of the App if you materially breach these Terms and do not remedy the breach within thirty days of written notice, or immediately where the breach is unlawful or presents a security risk. On termination, the licence in clause 03 ends, and data is deleted as described in the Privacy Policy.

Clauses on intellectual property, confidentiality, disclaimers, limitation of liability, and governing law survive termination.

18Changes to these terms

We may update these Terms. The version published at this address is the version in force, and the date at the top of this page shows when it last changed. Where a change is material and to your disadvantage, we will give notice through the Marketplace listing or the App before it takes effect. Continuing to use the App after a change takes effect means you accept the updated Terms.

19Governing law and disputes

These Terms are governed by the laws of Poland, excluding its conflict of law rules. The courts of Poland have exclusive jurisdiction over disputes arising out of them, except that either party may seek injunctive relief in any competent court. If you are a consumer, this clause does not deprive you of the protection of the mandatory law of your country of residence.
